County Appeal to the Third District Court
Miami-Dade County filed its Coconut Grove Playhouse appeal to the Third District Court of Appeal on August 21, 2020. You can see the appeal here.
On July 22, 2020, the lower court ruled in favor of the City of Miami on the narrow issue of “jurisdiction.” You can see the court’s opinion here. The court’s view was that City of Miami Mayor Francis Suarez’s veto was not quasi-judicial and therefore, the court had no jurisdiction to rule. The County’s appeal to the Third District Court of Appeal refutes this opinion.
It is important to note that the success of this latest appeal will mean that the lower court will be instructed to review the County’s case on its merits. Updates will be posted as more news is available regarding a court date.
